About Magnolia
Magnolia sits where FM 1774 (Magnolia Boulevard) meets FM 1488 in southwest Montgomery County, about 20 miles southwest of Conroe. First known as Mink's Prairie, the town took the name Magnolia in 1903 for the magnolia trees along Mill Creek, and it incorporated as a city in 1968. The city counted 2,359 residents in the 2020 census and has grown quickly since, as new subdivisions fill in along FM 1488 and FM 1774.
Our office is at 41040 Community Rd in Magnolia, so this is the area we know best: master-planned neighborhoods with HOA guidelines on one side, and wooded acreage with horses and long property lines on the other. Most of the area is in Magnolia ISD.
The city's parks include 30-acre Unity Park, a park and wildlife preserve with about 2.5 miles of trails, wetlands, and a splash pad, and The Stroll, a half-mile linear park linking Sullivan Park on FM 1488 with Unity Park. The Magnolia Depot, built in 1902 by the I&GN railroad, carries a state historical marker.

Subdivisions and acreage, often side by side
In Magnolia's planned neighborhoods, expect deed restrictions and an HOA or architectural committee that reviews fence height, style, and stain color. Acreage communities usually have a POA and deed restrictions rather than a full HOA, and some of them, like Lake Windcrest and High Meadow Estates, still review fences.
Much of the ground here runs sandy for the first couple of feet over clay. Sand digs easily but doesn't hold a gate or corner post on its own, so we set those deeper and wider than line posts and watch for low spots that hold water after heavy rain.
Permits
Inside the City of Magnolia limits, a fence needs a city permit. The city's fee schedule (amended November 2024) lists a $65 fence permit plus a $50 administrative fee, and the application asks for the fence's linear footage, material, and height. Much of the surrounding area is unincorporated Montgomery County, where a typical residential fence usually doesn't need a county building permit, though the county's floodplain rules can require a development permit for work in a mapped floodplain. HOA or POA approval may apply either way, and we confirm what applies to your address before we quote.
